The regular meeting of the Bowling Green City Council, held in the Council Chamber, 304 North Church Street, Bowling Green, Ohio was called to order at 8:00 p.m. by Council President Newlove.  The meeting began with the Pledge of Allegiance.

 

On roll call, Council Members Dunn, Frost, Heminger, Newlove, Sorrells, and Zanfardino responded.  Council Member McOmber was not present.  Also present were Mayor John Quinn, Municipal Administrator John Fawcett, City Attorney Michael Marsh, Parks and Recreation Director Michelle Grigore, Public Works Director Brian Craft, Utilities Director Kevin Maynard, and Planning Director Rick Ketzenbarger.

 

Council President Newlove declared the minutes of the meeting held August 18, 2008 approved as distributed.

 

 

CORRESPONDENCE

 

            There was no correspondence.

 

 

OFFICIAL REPORTS

 

            Mayor John Quinn reported that the winning postcards honoring the City’s 175^th Anniversary have been framed and are on display just outside the Council Chamber.  Mayor Quinn also noted upcoming events planned to honor the City’s anniversary.

 

            Mayor Quinn announced that the Community Reads events are set to kickoff in October and noted the book selected for this year’s program is Three Cups of Tea written by Greg Mortenson.  The first event will be held October 5 at 2:00 p.m. in the Library Atrium.

 

            Municipal Administrator John Fawcett had no report.

 

            Planning Director Rick Ketzenbarger had no report.

 

            Parks and Recreation Director Michelle Grigore reported that the Save the Woods annual wine and cheese fundraising event will be held on September 26 from 5:30-8:00 p.m.  Silent and live auctions are planned to be held in conjunction with this event.

 

            City Attorney Michael Marsh had no report.

 

            Utilities Director Kevin Maynard had no report.

 

            Public Works Director Brian Craft had no report.

 

 

NEW LEGISLATION

 

            The following new legislation was recommended by the Administration and presented to Council for introduction:

 

            Council Member Zanfardino, for the Community Improvement Committee, introduced a resolution to accompany application for Preserve America community designation.

 

            Council Member Zanfardino, for the Community Improvement Committee, introduced an ordinance amending and adopting Section 94.20, Section 94.27 and Section 94.28 of the Codified Ordinances of the City of Bowling Green, Ohio, concerning litter.

  

            Council Member Newlove, for the Public Utilities Committee, introduced an ordinance authorizing the Utilities Director to submit an application to participate in the Ohio Public Works Commission State Capital Improvement and/or Local Transportation Improvement Programs and to execute contracts necessary so as to obtain financial assistance for Water Distribution System and Wastewater Treatment Plan improvements.

 

            Council Member Newlove, for the Public Utilities Committee, introduced an ordinance authorizing the Utilities Director to advertise for bids and enter into a contract or contracts for Wastewater Treatment Plant concrete replacement improvements.

 

            Council Member Sorrells, for the Transportation and Safety Committee, introduced an ordinance repealing Section 98.02 an amending and adopting Section 98.03 of the Codified Ordinances of the City of Bowling Green, Ohio, regarding snow and ice covered sidewalks declared a nuisance.

 

            Council Member Sorrells, for the Transportation and Safety Committee, introduced an ordinance authorizing the Mayor and the Police Chief to execute the Northwest Ohio Regional Law Enforcement Mutual Aid Agreement for police and law enforcement assistance, and declaring an emergency.

 

            Council Member Frost, for the Planning, Zoning and Economic Development Committee, introduced an ordinance establishing interim zoning of B-2 General Commercial zoning for the approximately 1.78 acres of land on East Wooster Street recently annexed to the City of Bowling Green, Ohio, from Center Township as petitioned for by Robert W. Maurer.

READING OF LEGISLATION

            Council Member Sorrells moved, Zanfardino seconded, to adopt the emergency clause for Ordinance #7821.  On roll call vote, Council Members Heminger, Newlove, Sorrells, Zanfardino, Dunn, and Frost voted yes.  Council President Newlove declared motion carried, and the emergency clause adopted.

 

 

 

            Council Member Sorrells moved, Heminger seconded, to adopt Ordinance #7821.  On roll call vote, Council Members Newlove, Sorrells, Zanfardino, Dunn, Frost, and Heminger voted yes.  Council President Newlove declared motion carried, and Ordinance #7821 adopted.

            Clerk read Ordinance #7818 accepting annexation of approximately 1.78 acres of land in Center Township, Wood County, Ohio, from Robert W. Maurer, petitioner, for second reading.

 

            Clerk read Ordinance #7813 rescinding Ordinance #7172, for third reading.

 

            Council Member Frost moved, Heminger seconded, to adopt Ordinance #7813.  On roll call vote, Council Members Sorrells, Zanfardino, Dunn, Frost, Heminger, and Newlove voted yes.  Council President Newlove declared motion carried, and Ordinance #7813 adopted.

 

            Utilities Director Kevin Maynard requested that Council consider adding an emergency clause and giving second and third readings to Ordinance #7822 in order to meet the September 5, 2008 application deadline for submission.

 

            Council Member Dunn moved, Sorrells seconded, to suspend the rules and give Ordinance #7822 its second and third reading.  On roll call vote, Council Members Zanfardino, Dunn, Frost, Heminger, Newlove, and Sorrells voted yes.  Council President Newlove declared motion carried, and rules suspended.

 

            Clerk read Ordinance #7822 for second and third reading by number and title only.

 

            Council Member Dunn moved, Zanfardino seconded, to amend Ordinance #7822 to add an emergency clause in order to meet the application deadline.  On roll call vote, Council Members Dunn, Frost, Heminger, Newlove, Sorrells, and Zanfardino voted yes.  Council President Newlove declared motion carried, and Ordinance #7822 adopted.

 

            Council Member Dunn moved, Heminger seconded, to adopt the emergency clause for Ordinance #7822.  On roll call vote, Council Members  Frost, Heminger, Newlove, Sorrells, Zanfardino, and Dunn voted yes.  Council President Newlove declared motion carried, and the emergency clause adopted.

 

            Council Member Dunn moved, Sorrells seconded, to adopt Ordinance #7822 as amended.  On roll call vote, Council Members Heminger, Newlove, Sorrells, Zanfardino, Dunn, and Frost voted yes.  Council President Newlove declared motion carried, and Ordinance #7822 as amended adopted.

 

            Council Member Dunn moved, Frost seconded, to excuse Council Member McOmber from this evening’s meeting.  On unanimous voice vote, Council President Newlove declared motion carried.

  

Council Member Heminger moved, Sorrells seconded, to adjourn.  On unanimous voice vote, Council President Newlove adjourned the September 2, 2008 regular meeting of the City Council at 8:20 p.m., subject to call.
