CITY OF BOWLING GREEN CITY COUNCIL
MONDAY, OCTOBER 20, 2008
The regular meeting of the Bowling Green City Council, held in the Council Chamber, 304 North Church Street, Bowling Green, Ohio was called to order at 8:00 p.m. by Council President Newlove. The meeting began with the Pledge of Allegiance.
On roll call, Council Members Dunn, Frost, Heminger, McOmber, Newlove, Sorrells, and Zanfardino responded. Also present were Mayor John Quinn, Municipal Administrator John Fawcett, City Attorney Michael Marsh, Public Works Director Brian Craft, Utilities Director Kevin Maynard, and Planning Director Rick Ketzenbarger. Parks and Recreation Director Michelle Grigore was not present.
Council President Newlove declared the minutes of the meeting held October 6, 2008 approved as distributed.
CORRESPONDENCE
Clerk noted that a listing of budget transfers for the month of October was received from Finance Director Brian Bushong and distributed to Council prior to the meeting for approval. Council Member Frost moved, Sorrells seconded, to approve the transfers as presented. On unanimous voice vote, Council President Newlove declared motion carried. A copy of the transfers is attached and made a part of these minutes.
OFFICIAL REPORTS
Mayor John Quinn introduced Barbara Ruland as the new Executive Director of Main Street BG. Mayor Quinn noted that Ms. Ruland replaced Earlene Kilpatrick who was recently appointed as Executive Director of the BG Chamber of Commerce.
Municipal Administrator John Fawcett had no report.
Planning Director Rick Ketzenbarger had no report.
Parks and Recreation Director Michelle Grigore was not present.
City Attorney Michael Marsh had no report.
Utilities Director Kevin Maynard had no report.
Public Works Director Brian Craft reported that curbside leaf pickup began today and will be done several times during the fall season. Craft also noted that Quinn Concrete was the successful bidder for the City’s sidewalk program.
NEW LEGISLATION
The following new legislation was recommended by the Administration and presented to Council for introduction:
Council Member Newlove, for the Finance Committee, introduced a resolution transferring previously appropriated funds.
Council Member Newlove, for the Finance Committee, introduced a resolution authorizing the Finance Director to establish a special revenue fund entitled “Indigent Drivers Interlock and Alcohol Monitoring Fund” for the City of Bowling Green, Wood County, Ohio.
Council Member Newlove, for the Finance Committee, introduced an ordinance providing supplemental appropriations for the current expenses and other expenditures of the City of Bowling Green, Ohio, during the fiscal year beginning January 1, 2008 and ending December 31, 2008.
Council Member Newlove, for the Finance Committee, introduced an ordinance authorizing the Municipal Administrator to enter into a contract with the Bowling Green Convention & Visitors Bureau for the promotion and publicizing of the City of Bowling Green, Ohio, to bring the patronage and business of cultural, educational, religious, professional and sports organizations into the City for the benefit of the citizens of the City and the business community thereof, for a period of one (1) year, and authorizing the payment of 55% of the revenue generated by the hotel-motel tax for said purpose.
Council Member Newlove, for the Finance Committee, introduced an ordinance authorizing the Municipal Administrator to advertise for bids and enter into a contract or contracts and/or to participate in the State of Ohio purchase programs for the purchase of a 2-1/2 ton single axle dump truck, and declaring an emergency.
Council Member Sorrells, for the Transportation and Safety Committee, introduced an ordinance amending and adopting changes to certain sections of Chapter 93 of the Codified Ordinances of the City of Bowling Green, Ohio, regarding fire protection and prevention.
Council Member Frost, for the Planning, Zoning and Economic Development Committee, introduced a resolution authorizing the City Attorney to petition the Board of County Commissioners of Wood County, Ohio, to change township lines.
LOBBY VISITATIONS
Gary Pierce, 822 N. Christopher, addressed Council regarding the exterior condition of a neighbor’s property located at 828 N. Christopher. Mr. Pierce reminded Council that he had come before Council in the past and that the overall condition of the property has not changed. He indicated that he would like Council to pursue new legislation that would regulate outside maintenance requirements for property owners who refuse to keep their property in good condition.
Norm Heineman expressed his opinion to Council regarding the proposed legislation putting the cell phone ban on the ballot. Mr. Heineman urged Council not to base their decision on personal experience and to make the decision themselves rather than submitting it to the voters.

Clerk read Resolution #3371 approving revisions to the Transportation Section of the Comprehensive Master Plan of the City of Bowling Green, Ohio, for third reading.
Council Member Frost moved, Zanfardino seconded, to adopt Resolution #3371. On roll call vote, Council Members Frost, Heminger, McOmber, Newlove, Sorrells, Zanfardino, and Dunn voted yes. Council President Newlove declared motion carried, and Resolution #3371 adopted.
Mayor Quinn commented that a lot of hard work was put into the updating of the Transportation Section of the City’s Master Plan and thanked all of those involved in the process.
Clerk read Ordinance #7827 authorizing the Utilities Director to execute an environmental covenant and implement the mitigation plan required by the Ohio EPA 401 permit for the raw water intake and pumping station project, for third reading.
Council Member McOmber moved, Heminger seconded, to adopt Ordinance #7827. On roll call vote, Council Members Heminger, McOmber, Newlove, Sorrells, Zanfardino, Dunn, and Frost voted yes. Council President Newlove declared motion carried, and Ordinance #7827 adopted.
Clerk read Ordinance #7829 amending and adopting a portion of Section 150.03 of the Codified Ordinances of the City of Bowling Green, Ohio, concerning the definition of the term “bedroom”, for third reading.
Council Member Frost moved, Dunn seconded, to adopt Ordinance #7829. On roll call vote, Council Members McOmber, Newlove, Sorrells, Zanfardino, Dunn, Frost, and Heminger voted yes. Council President Newlove declared motion carried, and Ordinance #7829 adopted.
Council Member Zanfardino commented that he would like for the Community Improvement Committee to look into the issues brought up by Gary Pierce during lobby visitations.
Council Member McOmber moved, Dunn seconded, to adjourn. On unanimous voice vote, Council President Newlove adjourned the October 20, 2008 regular meeting of the City Council at 8:24 p.m., subject to call.
