The regular meeting of the Bowling Green City Council, held in the Council Chamber, 304 North Church Street, Bowling Green, Ohio was called to order at 8:00 p.m. by Council President Newlove. The meeting began with the Pledge of Allegiance.
On roll call, Council Members Dunn, Frost, Heminger, McOmber, Newlove, Sorrells, and Zanfardino responded. Also present were Mayor John Quinn, Municipal Administrator John Fawcett, City Attorney Michael Marsh, Parks and Recreation Director Michelle Grigore, Public Works Director Bill Blair, and Utilities Director Kevin Maynard. Planning Director Rick Ketzenbarger was not present.
Council President Newlove declared the minutes of the meeting held February 5, 2007 approved as distributed.
CORRESPONDENCE
Clerk noted that a listing of budget transfers for the month of February was received from Finance Director Rebecca Underwood and distributed to Council prior to the meeting for approval. Council Member Sorrells moved, McOmber seconded, to approve the transfers as presented. On unanimous voice vote, Council President Newlove declared motion carried. A copy of the transfers is attached and made a part of these minutes.
Clerk noted that copies of the Budget Summary Report for the month of January, 2007 was distributed to Council prior to this evening’s meeting.
Clerk further noted that the Municipal Court Annual Report was received and will be distributed to Council at the next Council meeting.
OFFICIAL REPORTS
Mayor John Quinn reported that a proclamation was issued today in honor of Earl Hipsher’s 100th birthday.
Mayor Quinn announced that TMACOG will be holding a public meeting on March 6 at the Wood County Library regarding the 2035 Transportation Plan. Mayor Quinn noted that the meeting begins at 7:30 p.m., but plans will be on display for the public to view beginning at 7:00 p.m.
Mayor Quinn also announced that Steve Meredith was appointed at the City’s new Fire Chief.
Mayor Quinn congratulated city workers in all departments for their efforts in the recent extreme cold weather and with the removal of snow throughout the city.
Municipal Administrator John Fawcett reported that 70 warnings were issued to citizens regarding the 24 hour removal of snow requirement and for the most part, citizens responded favorably. Fawcett noted that those warnings were issued as a result of both citizen complaints and personal observations by the Code Enforcement Officer.
Planning Director Rick Ketzenbarger was not present.
Parks and Recreation Director Michelle Grigore reported that a survey will be distributed to citizens regarding an aquatic facility. Meetings are scheduled for March 10 at 10:00 a.m., March 13 and March 15 at 7:00 p.m. at the Simpson Building to give information and help citizens in filling out their surveys. Grigore noted that a copy of the report from the survey will be distributed to Council in the future.
City Attorney Michael Marsh had no report.
Utilities Director Kevin Maynard had no report.
Public Works Director Bill Blair distributed a report to Council regarding costs involved with the recent snow storm. Blair noted that employees put in 798 hours of overtime
NEW LEGISLATION
The following new legislation was recommended by the Administration and presented to Council for introduction:
Council Member Zanfardino, for the Community Improvement Committee, introduced an ordinance amending and adopting Section 38.05(B) of the Codified Ordinances of the City of Bowling Green, Ohio, regarding the timing of hearings for contested civil infractions.
Council Member Newlove, for the Finance Committee, introduced an ordinance providing supplemental appropriations for the current expenses and other expenditures of the City of Bowling Green, Ohio, during the fiscal year beginning January 1, 2007 and ending December 31, 2007.
Council Member Newlove, for the Finance Committee, introduced a resolution transferring previously appropriated funds.
Council Members, for the Transportation and Safety Committee, introduced an ordinance amending and adopting changes to Chapter 114 of the Codified Ordinances of the City of Bowling Green, Ohio, regarding taxicabs and public transportation.
Council Member McOmber, for the Public Utilities Committee, introduced an ordinance establishing a uniform tap charge of $40.00 per front foot for the sanitary sewer extension located at 16518 Haskins Road.
Council Member McOmber, for the Public Utilities Committee, introduced an ordinance authorizing reimbursement to Jim Palmer Excavating, Inc., for oversizing and excess depth of the sanitary sewer extension serving the property located at 16518 Haskins Road, and declaring an emergency.
Council Member McOmber, for the Public Utilities Committee, introduced an ordinance amending Ordinance #7484 and authorizing the Utilities Director to include the Dill Street sewer replacement in the 2007 sub-standard sewer replacement projects.
Council Member Frost, for the Planning, Zoning and Economic Development Committee, introduced an ordinance partially vacating an east-west alley located between Inlot Number 853 on the north and Inlot Number 2264 on the south and running east from South Enterprise Street to a north/south alley.

LOBBY VISITATIONS
Max Rayle, 603 Lafayette, addressed Council on behalf of his client, Doug Valentine, expressing concern about the proposed partial vacation of a portion of Guild Street east of South Enterprise Street. Mr. Rayle pointed out that the ordinance indicates that this is an alley, but that it is actually a street. Mr. Rayle indicated the concern is that the vacation of this portion of the street will affect access to Mr. Valentine’s property.

Clerk read Ordinance #7641 authorizing the Municipal Administrator to advertise for bids and enter into a contract or contracts for tree plantings & tree maintenance for trees located within the public right-of-way of the City of Bowling Green, for third reading.
Council Member Newlove moved, Heminger seconded, to amend Ordinance #7641 by substitution to include an emergency clause on the ordinance. Council Member Dunn asked for an explanation for the need for an emergency clause on this legislation. City Attorney Michael Marsh responded that it is necessary to get the trees planted during the spring season while they are dormant in order to give the trees a better chance of survival. On roll call vote, Council Members Newlove, Sorrells, Zanfardino, Frost, Heminger, and McOmber voted yes. Council Member Dunn voted no.

Public Works Director Bill Blair commented at the conclusion of the meeting that countdown lights have been installed at the crosswalk located in front of Panera on Main Street. Blair noted that this type of light will also be installed at the four corners of Main and Wooster Streets in the very near future.
Council Member McOmber moved, Dunn seconded, to adjourn. On unanimous voice vote, Council President Newlove adjourned the February 20, 2007 regular meeting of the City Council at 8:40 p.m., subject to call.
